1. About these terms
These Terms of Service ("Terms") are a binding agreement between you and Cebu Taxi (registered business name to follow) ("Cebu Taxi", "we", "us"). They apply to the Cebu Taxi passenger app, driver app, operator portal, concierge tools and website at cebutaxi.com (together, the "Platform"). By ticking the agreement box and creating an account, or by using the Platform, you confirm that you have read, understood and accept these Terms and our Privacy Policy. If you do not agree, do not use the Platform. These Terms are entered into electronically and are valid under the Electronic Commerce Act of 2000 (Republic Act No. 8792).
2. Who we are and what we do
Cebu Taxi is a technology platform that lets passengers book rides with taxis operated by independent, franchised taxi operators holding a Certificate of Public Convenience from the Land Transportation Franchising and Regulatory Board (LTFRB). Cebu Taxi does not own taxis, does not employ drivers and is not a common carrier. The transport service is provided by the operator and its driver, who are responsible for complying with transport laws and regulations.
3. Eligibility and your account
- You must be at least 18 years old. Minors may ride only when booked by, or with the consent of, a parent or guardian who accepts these Terms for them.
- You must give accurate information, including your real name and a mobile number or email address you control.
- Your 6-digit passcode or password is personal. Keep it secret and do not share your account. You are responsible for activity under your account until you tell us it has been compromised.
- One person, one account. We may refuse or close accounts created with false details or to abuse promotions.
4. Booking a ride
When you request a ride, we offer it to nearby available drivers. A booking is confirmed only when a driver accepts it. Estimated arrival times and fare ranges are estimates only. Before boarding, check the taxi's body number and plate and confirm the ride PIN shown in the app. Do not board a vehicle that does not match.
5. Fares, discounts and payment
- Fares follow the rates approved by the LTFRB. The final fare is based on the taxi's calibrated meter and the actual distance and time travelled. The in-app price is an estimate.
- Tolls, terminal fees and other lawful extras are added separately and shown on your receipt.
- Students, senior citizens and persons with disabilities are entitled to a 20% fare discount under Republic Act No. 11314, Republic Act No. 9994 and Republic Act No. 10754, on presenting a valid ID to the driver. Misusing a discount may lead to account suspension.
- Any platform booking fee is shown before you confirm. You agree to pay the full amount due to the driver at the end of the trip.
6. Cancellations and no-shows
You may cancel for free within the free-cancellation window shown in the app. After that, or after the driver has arrived, a cancellation fee may apply as displayed before you cancel. Repeated late cancellations or no-shows may temporarily limit your access to bookings.
7. Passenger conduct
You agree not to:
- harass, threaten, discriminate against or harm drivers or other people;
- damage the vehicle, smoke or vape inside it, or carry illegal, hazardous or prohibited items;
- ask the driver to break traffic laws or exceed passenger capacity;
- make fake bookings, raise false SOS alerts or misuse the Platform in any way;
- copy, reverse-engineer, scrape or interfere with the Platform's security.
You are responsible for the cost of any damage or cleaning you cause.
8. Safety features
The SOS button, trip sharing, trusted contacts and route monitoring are provided to help you, but they depend on your phone, network signal and location settings and may not always work. They do not replace emergency services. In an emergency, call 911 or the nearest police station immediately.
9. Lost items
Report lost items through the app or support as soon as possible. We will try to connect you with the driver or operator, but we are not responsible for items left in a vehicle.
10. Drivers and operators
Operators must keep a valid franchise, vehicle registration, insurance (including compulsory third-party liability and passenger accident insurance required by the LTFRB) and meter calibration, and must only let licensed, verified drivers use the Platform. Drivers must hold a valid professional driver's licence and follow traffic laws. Additional operator terms, including subscription billing, are provided separately.
11. Intellectual property
The Platform, the Cebu Taxi name, logo, designs and software belong to us or our licensors and are protected under the Intellectual Property Code of the Philippines (Republic Act No. 8293). We give you a personal, non-transferable licence to use the apps for their intended purpose.
12. Limitation of liability
To the fullest extent allowed by Philippine law, the Platform is provided "as is" and "as available". Cebu Taxi is not liable for the acts or omissions of operators, drivers or other users, for delays, or for indirect, incidental or consequential losses. Where we are found liable, our total liability for any claim is limited to the amount of fees you paid to Cebu Taxi (not to the driver) in the three months before the claim. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, gross negligence or wilful misconduct, or your rights under the Consumer Act of the Philippines (Republic Act No. 7394).
13. Indemnity
You agree to compensate Cebu Taxi for losses, claims and reasonable legal costs arising from your breach of these Terms, your misuse of the Platform or your violation of any law or the rights of another person.
14. Suspension and termination
We may suspend or close your account if you break these Terms, if required by law, or to protect the safety of our users. You can delete your account at any time in the app under Account → Delete account. Sections that by their nature should survive termination (including fees owed, liability and dispute terms) continue to apply.
15. Complaints and disputes
Please contact us first at support@cebutaxi.com or through in-app support. We aim to respond within 3 working days and resolve complaints within 15 working days. If you are not satisfied, you may bring fare or driver-conduct complaints to the LTFRB, consumer complaints to the Department of Trade and Industry (DTI), and privacy complaints to the National Privacy Commission (NPC). Both parties will try in good faith to settle any dispute amicably, including through mediation, before going to court.
16. Governing law and venue
These Terms are governed by the laws of the Republic of the Philippines. Subject to your rights as a consumer, any case arising from these Terms shall be filed exclusively in the proper courts of Cebu City, Philippines.
17. Changes to these terms
We may update these Terms to reflect changes in the law or our services. We will notify you in the app or by email at least 15 days before material changes take effect. Continuing to use the Platform after that means you accept the updated Terms. If any part of these Terms is found invalid, the rest remains in force.
